Sim osam ser d.o.o. is a company headquartered in Belgrade, Serbia. We specialize in:

• IT consulting – advisory and implementation support in digitalization, IT infrastructure, and system optimization.

• Artificial intelligence (AI) & Automation – strategy, development, and deployment of intelligent business solutions.

• SaaS & Software Development – design and integration of customized IT solutions.

• Digital Transformation Services – including AI video generation, e-commerce, and workflow automation.

Our mission is to provide expert guidance and innovative IT solutions that help businesses work smarter, reduce costs, and grow sustainably.

2. Eligibility

By using our Services, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement. If you are using our Services on behalf of an organization, you represent that you have authority to bind that entity.

3. Scope of Services

Our Services are primarily consulting in IT and related fields. They may include:

• IT system analysis, planning, and implementation guidance.

• AI and automation strategies, including integration of AI chatbots, voice agents, and process automation tools.

• SaaS-based solutions and custom software advisory.

• Security, compliance, and optimization of IT systems.

• Support in digital transformation projects, such as website development or AI-driven content creation.

Unless otherwise agreed in writing, all Services provided are consultative in nature—we provide recommendations, design strategies, and may deliver technical solutions or coordinate with third-party providers when required.

4. Client Responsibilities

Clients using our Services agree to:

• Provide accurate and complete information necessary for consulting and project execution.

• Ensure lawful use of all delivered solutions and compliance with applicable regulations.

• Pay all agreed fees on time as specified in offers, contracts, or invoices.

• Maintain responsibility for final business decisions based on our consulting advice.

5. Intellectual Property

All materials, reports, methodologies, software, and documentation created by Sim osam ser d.o.o. in the course of providing Services remain our intellectual property unless explicitly transferred by contract. Clients receive a non-exclusive, non-transferable license to use deliverables for their internal business purposes.

6. Fees and Payments

• Fees for our Services will be agreed upon in advance through offers, contracts, or invoices.

• Payments must be made within the specified deadlines.

• Unless otherwise agreed, consulting fees are non-refundable, except where required by law.

• For subscription-based SaaS or ongoing services, payments may be recurring.

7. Third-Party Tools and Services

In delivering IT consulting, we may recommend, integrate, or facilitate the use of third-party software or platforms. We are not responsible for the functionality, terms, or performance of those third-party services. The client is responsible for accepting and complying with their respective terms.

8. Limitation of Liability

To the maximum extent permitted by law:

• Sim osam ser d.o.o. is not liable for indirect, incidental, or consequential damages, loss of profits, or business interruption.

• Consulting recommendations are provided in good faith, but final responsibility for business decisions lies with the client.

• Our liability shall not exceed the total fees paid by the client to us for Services in the 12 months preceding the claim.

9. Confidentiality

We respect the confidentiality of all client information. Data provided in the course of our Services will only be used for project execution, unless disclosure is required by law. Both parties agree to maintain confidentiality during and after the engagement.

10. Termination

Either party may terminate an engagement in writing, subject to the notice periods set in the contract. We reserve the right to suspend or terminate access to Services in case of breach of these Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Serbia. Any disputes shall be resolved by the competent courts in Belgrade, Serbia.

12. Changes to Terms

We may update these Terms from time to time. Updated versions will be published on our website and effective immediately upon posting.
